Start with the deeds, not a blanket equal-share rule

Section 4, particularly subsection (6), determines when the statutory scheme applies. A tenement burden allocating the entire liability for relevant costs can displace rule 4. The scheme also does not apply while a development management scheme applies. Ask your solicitor what applies to this building.

Which costs use the 1.5-times test?

For maintenance, inspection and related costs in Schedule 1 rules 4.1(a)–(d) and 4.2(b) relating to scheme property under rules 1.2(b) or (c), the costs are split by floor area if the largest flat is more than 1.5 times the smallest. Otherwise they are split equally. Exactly 1.5 times is not enough to trigger that rule. Rule 4.3 applies this approach to qualifying roof-over-the-close costs.

Do not apply this area rule to every bill: rule 4.2(a) normally uses ownership proportions for commonly owned property; rule 4.4 has specific insurance arrangements; rule 4.5 shares certain management, entry-system and other scheme costs equally. Rule 5 can redistribute missing shares. This tool does not calculate ownership proportions, insurance arrangements, missing shares or legal exceptions, and refuses those unsupported cost categories.
